DISCLAIMER AND LIMITATIONS

The information provided by Pet Watch (referred to as “we,” “us,” or “our”) on our online application (referred to as the “Platform” or “Pet Watch’s App”) is intended solely for general informational purposes. Our Platform only serves as a connection hub, linking Pet Owners and Pet Sitters (referred to individually “user”, “you” or “your”; and collectively as “users”) to facilitate the exchange of pet care services (referred to as the “Services”). Pet Watch itself does not provide pet care services. 

Our Platform aims to simplify the process by which Pet Owners can find and engage Pet Sitters for pet care needs, and by which Pet Sitters can offer their services. It is important to note that the information provided on the Platform is meant to support these connections and does not constitute professional advice or endorsements. Although we strive to provide accurate and reliable information on our Platform, we cannot guarantee its completeness or correctness. We make no promises or warranties, either expressed or implied, about the accuracy, reliability, or availability of the information on our Platform.

Under no circumstances shall Pet Watch have any liability to any User or third party for any of the following:

1.1. Pet Watch is not a veterinary, nutrition or healthcare provider.

The Pet Watch app and the content available through it, including information on pet care, are intended for general informational purposes only and should not be considered as professional advice. Pet Watch is not responsible for any actions taken based on the information provided, and it is not a substitute for professional veterinary, nutritional, or healthcare advice.

Pet Watch disclaims all warranties, whether statutory, express, or implied. This includes, but is not limited to, implied warranties of merchantability and fitness for a particular purpose. This disclaimer applies to any services offered by pet sitters via the Pet Watch app.

Therefore, the information provided by Pet Watch should not be used to assess your pet’s health status or diagnose any medical conditions. For accurate health assessments and diagnoses, consult a qualified professional.

1.2. Liability Limitations

We will not limit or exclude our liability where it is unlawful to do so. This includes liability for death or personal injury caused by our negligence, as well as for fraud.

To the fullest extent allowed by law, Pet Watch and its affiliated companies—including parent companies, subsidiaries, and their respective officers, directors, shareholders, employees, contractors, service providers, agents, successors, and assigns (collectively referred to as the “Pet Watch Parties”)—will not be responsible for any direct or indirect damages you or anyone else might experience due to the usage of the services offered by Pet Sitters obtained through the Pet Warch’s APP. This includes, but is not limited to, losses related to the use of services offered by pet sitters through the Pet Watch app, such as loss of use, data, business, or profits.

If a court determines that Pet Watch is liable for any damages despite this limitation, Pet Watch’s total responsibility will not exceed the amount you paid for the specific service (referring to the amount paid by the Pet Owner to the Pet Sitter in such transaction) that led to the claim. This means that the maximum amount Pet Watch would owe you is limited to the payment made for that service.

1.3. Independent Parties (Pet Owners and Pet Sitters)

Pet Watch is a platform that connects Pet Owners with Pet Sitters, who are independent contractors and parties. Pet Watch does not employ, own, or control the Pet Sitters and does not evaluate the Pet Owners. 

As a result, Pet Watch makes no representations or warranties regarding the Pet Sitters or Pet Owners and is not responsible for their actions or omissions. You understand that any interactions with users through the Platform are at your own risk. Pet Watch is not liable for any damages, including but not limited to, personal injury, death of pets, theft of personal belongings, or any special, exemplary, punitive, incidental, or consequential damages arising from your use of the Platform or your interactions with other users.

1.4. Associated Risk

You hereby acknowledge and agree that by using the Pet Watch platform to connect with Pet Sitters, you assume full responsibility and risk for your decision. Pet Watch is not liable for any harm, loss, or damage, including but not limited to your pet’s injury or death, theft of your belongings, or any other financial loss resulting from your interaction with/ arising out of pet sitters’ performance (actions and omissions).

1.5. Health and Safety

Pet Watch will not be held responsible or liable for any physical harm or health issues that pets or users may experience, including but not limited to allergic reactions, during or after the interaction and performance of any Pet Sitter connected through the platform. 

By using Pet Watch, you acknowledge that you accept all risks associated with pet health issues when using Pet Watch’s platform and agree to hold Pet Watch Parties harmless from any claims or expenses related to the above-mentioned issues. This includes, but is not limited to, any claims, liabilities, losses, damages, costs, or other expenses arising from pet allergies or health problems.

1.6. Exclusive Remedy

Your sole recourse for any issues or dissatisfaction with the Pet Watch app is to discontinue its use and, if necessary, remove it from your device. While we strive to provide a seamless experience, the app is provided “as is” and we make no warranties regarding the app’s performance or functionality. 

1.7. No Guarantees on App Functionality

Pet Watch does not guarantee that the app will be uninterrupted, error-free, or that any defects will be fixed. We also do not guarantee that downloading, installing, or using the app or website will be free from viruses or harmful components. It is your responsibility to use your own virus protection software. Pet Watch and its representatives make no warranties about the app’s accuracy, reliability, availability, or any other aspect of its performance.

Pet Watch will not be responsible for any indirect, special, consequential, or incidental damages that arise from using or being unable to use our digital services, websites, or devices. This includes situations where such damages were foreseeable. Therefore, Pet Watch is not liable for any damages that occur as a result of using our digital services or technology, even if we could have anticipated them.

Additionally, Pet Watch is not responsible for any damages or problems caused by technical issues, including but not limited to problems with telephone networks, online systems, servers, computer equipment, software, or internet congestion. This includes any injuries or damage to users or their computers that might occur because of using our platform. Therefore, we are not liable for any issues that arise from technical difficulties with our service or related systems.
