At Pet Watch, one of our top priorities is protecting the privacy of our pet owners, their furry family members, and our pet sitters (collectively referred to as “Users”). We are committed to providing the highest level of protection for your personal data under the laws of the United Arab Emirates (referred to as the “UAE”), including Data Protection Law No. 5 of 2020 from the Dubai International Financial Centre (referred to as the “DIFC”) (collectively referred to as the “UAE Laws”).

As the data controller under UAE Laws, Pet Watch determines the purpose and means of processing your personal data. We respect the privacy of everyone using our mobile application (referred to as the “Platform”) and are dedicated to protecting any personally identifiable information you may share with us through the Platform, telephone, email, or any other means (referred to as “Personal Data” or “Information”). We collect and use this information in accordance with this Privacy Policy and UAE Laws.

If you do not accept and agree with our Privacy Policy, then we request that you do not access the Platform any further. If you choose to proceed and provide any information without acknowledging this Policy, you would do so at your own risk and liability. Non-acceptance of this Privacy Policy shall limit your access to the Platform and any of the pet-care-related services offered by Pet Watch. We reserve the right to update this Privacy Policy to ensure the utmost privacy of its Users, and by accepting this Policy, you consent these changes without requiring your further approval.

This Privacy Policy, in accordance with the UAE Laws, describes what Personal Data we collect, how we use it, how it may be shared, and your choices and rights regarding your Personal Data. Pet Watch is committed to respecting your privacy and complying with all applicable UAE Laws and regulations concerning the use, limitation, and disclosure of Personal Data that we may collect. Your access to and use of our Platform is subject to this Privacy Policy, the Terms & Conditions, and any other Pet Watch policies. By providing us with your Personal Data, you expressly consent to us processing your Personal Data in accordance with the terms of this Privacy Policy.

The terms “we,” “us,” “our” or “Pet Watch” or “Data Controller” refer to MAM Technologies Portal Limited. By “you,” we are referring to the pet owners, their furry family members, the pet sitters, and any other person(s) accessing any part of our Platform.

1. COLLECTION OF INFORMATION

Once we have received your confirmation, acceptance and agreement to this Privacy Policy, we collect Personal Data and information associated with your device which you provide us directly, or from third parties with your consent, and automatically when you use our Platform. We gather this Information via online forms and/or using cookies and similar technologies as outlined in our Cookie Policy set out below, through your access and use of the Platform, or when you enter data on the Pet Watch website or app. at any point in time during the navigation of the Platform. We may also collect general, aggregated, demographic, non-personal and any other information to enhance your experience on the Platform.

Any information that has been voluntarily disclosed by you to us in a professional context will be considered explicit consent for us to process that information this Privacy Policy.

Pet Watch offers experiences on social media platforms that enable sharing and collaboration among registered users. We may collect information you share with us on social media, such as photos, comments, testimonials, opinions, or your social media account ID. Content you post on these platforms, including pictures, information, and opinions, is subject to the terms of use and privacy policies of those platforms. Please refer to those policies to understand your rights and obligations regarding such content.

What Data do we collect?

We collect and hold information that is relevant to the context of our business transactions with Users. While most of this information and Personal Data is provided by you, we may also obtain data from different sources such as your bank, third parties, and publicly available information. 

Here are the main types of information we may collect, collate and process from time to time while you use the Pet Watch platform:

Account and Profile Information. 

When you create an account by completing our registration form, we collect personal information such as your name, email, interests, gender, age, address, location, nationality, identification documents, phone number, username, password, and pet details (name, age, medical, diet). We also gather information from your profile, platform interactions (questions, surveys), and any content you post. Additionally, we may collect further information during your platform use, including identification documents, purchase history, communications, and, for Pet Sitters, past pet care experience. Please note that registration requirements might change over time.

Content You Submit. We collect information and content that you submit, post to, or create on our Platform, including your photos, videos, comments, reviews, searches, and other types of content provided for in our Pet Watch management tools. Please note that Pet Watch shall not share any of your Personal Data with any third party unless required for improving our Pet Watch’s seamless experience as specified hereunder. 

Purchases/ Bookings. When you purchase or book any pet-care-related service through our Platform, we collect certain information to complete your transaction, such as your phone number and address. We also gather data from your of our Platform (including electronic communications), payment transaction data, bank account details, the language setting of your device, consent to and recognition of the terms of use and acknowledgment of the Privacy Policy, the status of the user account, and the default app tracking setting (which allows us to track the live location of Pet Sitters during their service time and lets Pet Owners trach their pets during this period).  Please note that we do not collect, save, process, amend, or change your bank account or card details at any time for any reason whatsoever.

Communications. When you communicate with us via email, through our Platform, on social media or by other means, we may record, monitor, and collect details about these communications. This includes information such as call time and call duration.  

Surveys and Contests. When you take part in our surveys, reviews, or promotions, we collect the information you provide. This helps us improve our serviced and tailor our offering to better meet your needs. 

Social Media.  When you interact with Pet Watch on social media, we collect your username and any content from your interactions. This helps us understand your preferences and improve our services.

Information from Others. We collect information that others make available to us, including information from other platforms, publicly available information, information from other users of our Platform, information from our partners, service providers, and corporate affiliates, and information from third-party sites.

Other Platforms. We might get information about you from other services if you let them share it with us (third-party platform). For example: If you sign up for our Platform using Facebook, Google or Apple; if you upload your contacts from your email service provider; If you use our platform to manage your calendar or send messages though another service. 

Publicly Available Information. If you are a Pet Sitter, we may collect and display information about you, such as experience, certifications, and other relevant details, from publicly available sources. This information will be used as part of your profile on our platform, subject to applicable laws and your consent where required.

Other Users and Customers. Other users might share your information with us when they use our platform. This could happen if they refer you to our services or interact with you through ads on our platform. Pet Sitters may also share details about how you interact with them, like if you’ve contacted them or responded to their messages. If you’re a Pet Sitter, keep in mind that Pet Owners might give us feedback or leave reviews about your services.

Our Partners. We might get information about you from our partners. For instance, if you make a payment, our payment processors might update your payment details. Advertising partners could assist us in sending you relevant communications. Additionally, third parties may help us verify your contact information to prevent fraud and ensure the security of our services.

Third-Party Sites. Certain third-party websites may include Pet Watch features like buttons, widgets, or content. These might be Pet Watch-branded or co-branded with other partners. When you use these features, they might collect information according to our Cookie Policy. If you use our browser extensions, they will also collect information as described in this Privacy Policy. Please note that Pet Watch will never share your credit or debit card details with third parties. However, we are not responsible for the privacy practices of other websites we link to. If you provide information to these other sites, their own privacy rules will apply. For questions about how your data is used by these other sites, please contact them directly.

Automatically Collected Information. Every time you use our Platform, your web browser or app sends information to our servers. We keep track of how you use our Platform, including what pages you visit, what you search for, and the date and time of your visit. If you use our browser extensions, we also collect information about how you interact with other websites through these extensions. For example, if you save an image from another website to your Pet Watch account, we’ll know about that. We also collect details from your device, such as your browser type, device type, browser language, IP address, and other technical information about how you connect to our Platform.

Cookie Policy

To ensure that our Platform works correctly, we may at times place a small piece of data known as a cookie on your used device. Cookies are small files or records that Pet Watch may place on your browser for collecting information about your activities on the Platform, preparing reports, assessing trends, and otherwise monitoring the way in which the Platform is being used (referred to as “Cookies”). The content of a Cookie can be retrieved or read only by the server that creates the Cookie. The text in a cookie often consists of identifiers, site names, and some numbers and characters. Cookies are unique to the browsers or mobile applications you use and enable websites to store data such as your preferences or items in your shopping cart.

Like many other websites or Internet service providers, Pet Watch may use Cookies, or other technologies, on this Platform to improve your user experience. Session Cookies are deleted after each visit, while persistent Cookies remain in place across multiple visits. Cookies allow websites to remember your settings such as language, font size on your computer or mobile device, or other browser preferences. This means that a user does not need to reset preferences for every visit. On the contrary, if Cookies are not used, websites will treat you as a new visitor every time you load a web page. 

The type of Cookies and other tracking technologies used on our Platform can be categorised as follows:

• Essential Cookies are required for the functional operation of the Platform and are used to, but not limited to, identify you while using the Platform, remember settings you have applied on the Platform such as choice of language or region.
• Non-essential Cookies are used to improve tour experience by tracking how you use our Platform, showing personalized ads, and analysing performance.
• Third Party Cookies, displayed by us from other websites or services being stored on your hard drive or browser. Please note Pet Watch does not control the storage and use of these cookies by third parties and you should refer to the privacy policies of the relevant third parties for more information.

Our use of Cookies on the Platform is intended to enhance your experience and convenience, customize your visit to the Platform, and to assist Pet Watch to run an efficient operation for your safety. Cookies can be created automatically on the device you use to access the Platform but do not contain Personal Data and do not compromise your privacy or security. 

By accepting this Privacy Policy, you confirm your consent to Pet Watch’s use of Cookies, and other such technologies, for these purposes. If you have contacted us, are browsing our Platform, or have shown interest in our services, you are also agreeing to the collection and storage of this information.

If you do not consent, it is your responsibility to disable or restrict the placement of Cookies by configuring your browser settings which may affect your ability to use the Platform or to immediately refrain from using the Platform. Please note that turning off or deleting cookies will not prevent device identification and related data collection from occurring.

Location Information

We will receive your device’s location if you enable this through your browser or mobile device. We may infer your general location from your IP address. You may also choose to provide us with your location information by inputting this information into our Platform, including in your Pet Watch settings, or as a billing address.

We will share the live location data of the Pet Sitters with the Pet Owners in order to enable Pet Owners to keep track of their pet’s whereabouts while being under the care/ attention of their relevant Pet Sitter and only during the duration of their service time. 

These Pet Owners will have access to the live location information of their relevant Pet Sitter only to the extent necessary and only during the specified service time. Once such service time is duly completed, neither we nor the Pet Owners will have access to the Pet Sitter’s live location in any manner whatsoever. 

2. USE OF INFORMATION

Our values are at the heart of everything we do! As mentioned above, Pet Watch sincerely respects and cares about your privacy and is committed to protecting your Personal Data.

Except as otherwise stated below, we do not sell, trade, or rent your personally identifiable information collected on our Platform to others. We use the Personal Data we collect to provide, support, and personalize our Platform and to communicate with you about our Platform (on and off our Platform) relating to marketing, compliance, reporting, fixing bugs and bookies, market research, analysis, and transactional services. Personal Data is only collected for specified, explicit and legitimate purposes only and is not further processed in a manner that is not compatible with these purposes and our values. 

The ways we do this include but are not limited to the following:

1. to provide and improve our Platform and its features and functionality, including but not limited to displaying the content you post publicly, process, storing, and delivering your communications; to provide customer service and support; to respond to your inquiries or requests; to back-up our systems; and to improve the security of our Platform;
2. to evaluate the use of our Platform for our business purposes and to provide and improve our services, including new and co-branded services and our Platform’s functionality;
3. to personalize your experience, such as tailoring the content and information made available to you and our support services;
4. to display relevant advertising (on our Platform and third-party sites) for us and other businesses and to evaluate the success of such advertising;
5. to provide feedback to Pet Sitters on our Platform;
6. to communicate with you as described in our agreements with you (for example, the Pet Watch Terms and Conditions) or this Privacy Policy;
7. to prevent fraud and to maintain a quality experience for our business purposes or legal reasons, including filtering for spam and communications that violate our agreements with you (for example, the Pet Watch Terms and Conditions);
8. to enforce compliance with our agreements with you (for example, the Pet Watch Terms and Conditions) and applicable laws; to comply with our legal obligations; to prosecute or defend a lawsuit, arbitration, or similar legal proceeding; to respond to lawful requests by public authorities (including national security or law enforcement requirements);
9. to perform research and analysis for our business purposes; and
10. to award badges and similar designations and if you decide to participate, to administer surveys, contests, and promotions.

Here’s how we use the information you provide and interact with us:

• Contacts: If you provide us with information about your contacts (for instance, by signing up through Facebook or another social media platform), we may let your contacts know that you’ve joined our Platform. This helps you connect with them and follow their public activities on our Platform.
• Communications: We may review your communications for quality assurance and to improve our services. This can include using automated technology to help us understand and manage the quality of interactions between Pet Sitters and Pet Owners and improve user experience. 
• Usage information: We collect information about your log-ins, cookies, device details, IP addresses, and other data to identify you and personalize your experience. This includes tracking how you use our Platform across different devices.
• Payment information: we and our payment processors will store information about the payment method you use in connection with the Platform with your consent. All credit/debit cards’ details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties.

Any use of your information that is incompatible with these uses will be disclosed to you in advance so that you may opt out of, or agree to, such uses at your discretion. If you would like to opt out of any of the uses of your information mentioned in this Privacy Policy at any time, please contact us as described in the Contact Us section below or refrain from using the Platform immediately.

3. SHARING YOUR INFORMATION

Information about our Pet Owners, their friendly family members, and the Pet Sitters is an important part of our business model. The Platform may contain links to other websites as a convenience to you and other Users of the Platform. We make no representations or warranties as to the content, privacy practices and other practices of any websites operated by a third party and Pet Watch does not assume responsibility for the content or practices of such websites. Please note that the use of any such third-party websites will be at your own risk and it is your sole responsibility to review the terms, privacy policies, and other policies for said websites for safeguarding your information. 

We share your Information only as described below and with businesses that follow practices at least as protective as those described in this Privacy Policy:

1. Other Businesses. To offer you our services, we may engage with businesses that are affiliates of ours and/or non-affiliated service providers (e.g., marketing companies, payments processors to process online transactions, etc.). Please note that we may involve other businesses, that are crucial and necessary for the efficient working of the Platform, which may store your Information to make your use of our Platform more efficient.

We may share your information with third-party businesses to help them perform their functions related to the Platform. While we ensure they use your information only for this purpose, we can’t guarantee how third parties will handle it. We may also receive updated information from these businesses to keep our records accurate. By using our Platform, you agree to the transfer and use of your information by affiliated and non-affiliated service providers, who are required to protect your privacy according to UAE laws.

1. Marketing and Promotional Offers. We may use your information to provide you with updates on services, new features, special offers, and events that you might find interesting. This includes communicating with you through various channels such as emails, push notifications, web notifications, and in-app messages. If you do not wish to receive these updates, you can opt out by contacting us, adjusting your settings on your Pet Watch account, or unsubscribing from our email newsletter. Additionally, we may allow third parties to use your information for targeted advertising. For example, we might share information with advertisers to help them reach their desired audience and fulfill advertising commitments.
2. Business Transfers. In the event that we or substantially all of our assets are acquired by another entity, customer information will be one of the transferred assets and will be handled as per this Privacy Policy and applicable laws.
3. Protection of Our Platform and Others. We may share your account and other information if we need to comply with the law, respond to law enforcement, or protect the safety and rights of our users and others. This may include sharing information with other companies and organizations to prevent fraud and reduce credit risk. Additionally, our Platform may link to other websites from our partners, advertisers, or affiliates. If you visit these websites, be aware that they have their own privacy policies. We are not responsible for their policies, so please review them before providing any personal information.
4. Data processing. Pet Watch may share your data with third parties to assist with various services, including:

• Data Processors: Companies that handle data processing tasks for us. Any data processing activities undertaken by such providers shall not require your consent
• Service Providers: Organizations that provide hosting, programming, or hotline support.
• Other Third Parties and Corporate Affiliates: Include service providers and other companies within our corporate group.

We may also need to share your data with others if required by legal regulations or court orders.

     5. Information that we create. Pet Watch may create User Information about you, such as records of your interactions with us and details of our business-related activities including but not limited to phone calls, emails, minutes, and all business activity provided for on the Platform.

     6. Location Information to Pet Owners. In addition to the above, we will share the live location data of the Pet Sitters with the Pet Owners in order to enable Pet Owners to keep track of their pet’s whereabouts while being under the care/ attention of their relevant Pet Sitter and only during the duration of their service time. These Pet Owners will have access to the live location information of their relevant Pet Sitter only to the extent necessary and only during the specified service time. Once such service time is duly completed, neither we nor the Pet Owners will have access to the Pet Sitter’s live location in any manner whatsoever.

4. COMMUNICATIONS

When you create an account on our Platform, you agree to receive communications from Pet Watch via email, push notifications (if using our mobile app), and other methods. These messages may include updates about your account, privacy, and Platform news. We may also request feedback on your experience with the Platform and Pet Sitters or Pet Owners.

Additionally, we may send marketing messages with tips, offers, and related services from Pet Watch. If you provide your email address, we may contact you to assist with your use of the Platform. Pet Sitters may be contacted for marketing or service-related purposes.

If you provide us with your email address, we may contact you to help you with using the Platform (e.g., to discuss your preferences, concerns, etc. about your furry friend). If you are a Pet Sitter, we may use your contact information (whether publicly available or provided to Pet Watch) to call and otherwise contact you about our Platform, including to market and sell your services or those available on our Platform.

You can manage your communication preferences through your Pet Watch settings. Note that you cannot opt out of account-related messages, but you can disable push notifications in your mobile settings. Pet Watch is not responsible or held liable for incorrect information you provide, so please ensure your details are accurate for the best experience.

      5. DATA PROTECTION

Data Controller Identity: The Pet Watch is the Data Controller as well as the Data Processor (as defined in the DIFC Data Protection Law No. 5 of 2020), which is responsible for the collection and processing of your Personal Data in accordance with this Privacy Policy and UAE Laws.

Categories of Personal Data: The Data Controller shall only collect and process, subject to your explicit consent, that Personal Data which is set out in detail in the ‘What data do we collect?’ section (see above).  

Explicit Consent: All Personal Data collected and/or processed by Pet Watch, i.e., the Data Controller, shall be subject to all applicable UAE Laws and, in particular, the DIFC Data Protection Law No. 5 of 2020. The Data Controller shall only collect and process the above-mentioned Personal Data upon provision of your explicit consent, by understanding, accepting, and agreeing to this Privacy Policy and any other ancillary policy pertaining to the protection of your Personal Data. In case you do not agree to this Privacy Policy, you understand that the Data Controller may not be able to collect/ process your Personal Data required for the purpose of provisioning pet-care-related services offered by us and may limit the functionality and availability of certain features of our services on the Platform. 

Specific Purpose and Duration: The Data Controller shall collect and process such Personal Data in accordance with the UAE Laws and such Personal Data shall be held in strict confidence and used only for specific lawful purposes for which it is required. 

Transfer of Personal Data: You further acknowledge, accept, agree, and confirm that it may also be necessary from time to time for the Data Controller to transfer and/or forward such Personal Data to third parties outside the DIFC and/or the UAE (as specifically set out at Section 3 above) for storage and processing of the Personal Data for administrative purposes, as may be necessary from time to time.

Data Subject Rights: You, being the “Data Subject”, shall have the following rights with respect to your Personal Data (as further elaborated under Sections 6 and 7 below):

1. Right to Access: You have the right to request access to the Personal Data we hold about you.
2. Right to Rectification: You have the right to request the correction of inaccurate or incomplete Personal Data.
3. Right to Erasure: You have the right to request the deletion of your Personal Data under any circumstances.
4. Right to Restriction: You have the right to request the restriction of processing of your Personal Data.
5. Right to Data Portability: You have the right to receive your Personal Data in a structured, commonly used, and machine-readable format.
6. Right to Object: You have the right to object to the processing of your Personal Data at any time.
7. Right to Withdraw Consent: If we rely on your consent to process your Personal Data, you have the right to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

Updates to this Section: We may update this Section from time to time to reflect changes in our data processing practices or to comply with legal requirements. Any updates will be posted on our Platform, and the effective date will be revised accordingly.

6. YOUR CHOICES AND RIGHTS

At Pet Watch, we prioritize your privacy and are committed to responding to all requests related to data protection in line with applicable laws. To ensure your request is handled securely, we may need to verify your identity.

• Access and Deletion requests. You have the right to control your personal data. If you want to access, update, or delete your information, you can do so through your Pet Watch settings or by contacting us directly via the details in the ‘Contact Us’ section. We will process your requests promptly and take all necessary steps to ensure your data is handled appropriately.
• Editing your information. You can manage and update your personal information, including marketing preferences, directly on our Platform. If you need help with corrections or updates, please reach out to us using the contact methods provided. We will consider your request in accordance with the UAE Laws and will take care of your concerns at all times.
• Location information. You also have control over your location data. You can adjust or withdraw consent for location tracking in your device settings. If you prefer to disable location tracking, you can contact us to do so. Be aware that disabling location services might affect certain features of our Platform.

7. ACCOUNT TERMINATION AND DATA RETENTION

We want to make it easy for you to manage your Pet Watch account, and if you are not a professional, service provider, or Pet Sitter, you can deactivate your account anytime by simply going to your Pet Watch settings. However, if you are a Pet Sitter and need to deactivate your account, please reach out to us using the contact information provided in the ‘Contact Us’ section of this Privacy Policy, and we will assist you with the deactivation process. Once deactivated, your Pet Watch profile will no longer be accessible on the Platform but in accordance with applicable laws and the Pet Watch Terms and Conditions, your reviews, and other content may still be available through our Platform. In order to request the permanent deletion of the Personal Data associated with your account, please contact us as described in the ‘Contact Us’ section below.

We will keep your Personal Data only for as long as necessary to fulfil the purposes for which we are processing your personal information unless the law permits or requires us to retain your personal information for a longer period. 

8. AGE OF CONSENT

Our Platform is intended for all concerned Pet Owners out there and may be directed to individuals under 18 years of age. If you are below 18 years of age, you may use the Platform only by the provision of a valid Emirates ID to Pet Watch and with the consent and supervision of a parent or legal guardian who agrees to be bound by the Terms and Conditions and this Privacy Policy and responsible for ensuring such use to be permitted under UAE Law and any other applicable law. 

We do not knowingly collect personal information from individuals under 18 years of age unless we have received proper consent and identification. If we discover that we have collected information from someone under 18 without proper consent, we will take steps to delete that information. If you believe that someone under 18 has given us their personal information, please let us know using the contact details provided in the ‘Contact Us’ section. 

By using this Platform, you consent, agree, and represent that you are 18 years of age or have reached the age of majority in the jurisdiction in which you reside or have obtained a parent or legal guardian’s consent to use the Platform. 

9. DATA SECURITY

We use reasonable and appropriate measures to protect your Personal Data (as defined above) from loss, misuse, unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the personal information. Pet Watch takes appropriate steps to ensure data privacy and security including through various hardware and software methodologies. We further take reasonable measures to protect your location information from unauthorized access, disclosure, alteration, or destruction. However, Pet Watch cannot guarantee the security of any information that is disclosed online. 

You are responsible for keeping your Account username and password confidential and preventing unauthorized access to your profile. This includes but is not limited to managing all activities under your Account, such as submitting content like images, descriptions, and reviews. Ensure that your login details are secure and immediately notify Pet Watch if you suspect any unauthorized access. Remember, Pet Watch will never ask for your username or password through electronic messages. We are not liable for any loss or damage resulting from a failure to protect your Account information.

10. UPDATES TO THIS PRIVACY POLICY

This Privacy Policy, the Terms & Conditions, and other website policies may be changed or updated occasionally without notice, as per the updated and effective laws, requirements, and regulations at any given time. The most current version of our Privacy Policy will govern our use of Information about you. You are encouraged to frequently review these sections to be updated about the changes on the Platform. Modifications will be effective on the day they are posted. Your continued use of the Platform shall constitute your express consent and agreement to be bound by the Privacy Policy, Terms & Conditions, and other policies of Pet Watch. If you disagree with this Privacy Policy, you must immediately refrain from using the Platform.

11. NO WARRANTY

You understand that Pet Watch does not provide any warranty, guarantee, or representation of any kind concerning our ability to control, collect, correct, access, process, use, store, protect or transfer any personal information or concerning the existence or effectiveness of any security measures undertaken by us. You agree that Pet Watch will not be liable for any claims, losses, or damages of any kind whatsoever which may result from the access, disclosure, use or modification by any party not authorised or authorised by us, or the introduction of viruses, worms, or other harmful elements into the system and their possible effects on your personal information.

12. LIMITATION OF LIABILITY
